An advance copy of the new USCIS rule related to how DHS applies the public charge ground of inadmissibility has been released. DHS proposes to use the definition "likely at any time to become a public charge" as "likely to become primarily dependent on the government for subsistence." The Notice of Public Rule Making was published in the Federal Register on February 16, 2022. The Department of Homeland Security press statement can be found here on the proposed rule. If you would like to read the proposed rule, it can be found here.
